GAINS software as a Software-as-a-Service
(SaaS) solution.

while providing the GAINS Service.
The defined terms in this Policy have the same meaning
as in our Terms of Use and should be read together with

The Service involves the storage and processing of Data
relating to companies, organizations and individuals.

Windfall hosts Your personal information on servers
located in Singapore
All Data, including personal and non-personal information
entered into the GAINS Service, is currently hosted on
servers located in Singapore.
These servers are owned and controlled by
Windfall Consultancy Private Limited
and are hosted within IBM infrastructure in Singapore.
Your information may be transmitted to, processed on and
stored on these servers as part of providing the GAINS Service.
Windfall maintains control over the Data stored on these
servers and takes reasonable technical and organizational
measures to protect such information against unauthorized
access, modification, disclosure, loss, destruction or misuse.
Access to servers and stored information is restricted to
authorized personnel who require access for legitimate
purposes including administration, maintenance, technical
support, security, backup and recovery.
Windfall may in the future migrate or host some or all
GAINS infrastructure with other data centre or cloud
infrastructure providers, including Microsoft Azure.
If there is a material change to the location or manner
in which personal information is stored or processed,
this Privacy Policy will be updated accordingly.
Windfall takes steps to protect Your personal information
Windfall is committed to protecting the security of Your
personal information.
We implement reasonable administrative, technical and
organizational safeguards designed to protect information
against unauthorized access, modification, disclosure,
destruction or loss.
GAINS uses secure servers and encrypted communication
technologies, including SSL/TLS, where applicable.
Access to production systems and sensitive information
is restricted to authorized persons.
However, no electronic communication, Internet transmission
or information storage system can be guaranteed to be
completely secure.
Users are therefore also responsible for maintaining
appropriate security practices, including protecting their
usernames, passwords, devices and access credentials.
Data Retention
Windfall Consultancy Private Limited retains personal
information only for as long as reasonably necessary
to provide and maintain the GAINS Service, fulfil contractual
obligations and comply with applicable legal, accounting,
taxation, security and regulatory requirements.
Business, accounting, inventory, taxation, financial and
transactional information entered into GAINS may be retained
for the duration of the customer's subscription and for
such additional period as may be required by applicable
laws or by the organization subscribing to GAINS.
After termination or expiry of a GAINS subscription,
certain information may continue to be retained where
reasonably necessary for:
- legal and regulatory compliance;
- accounting and taxation requirements;
- audit purposes;
- security and fraud prevention;
- backup and disaster recovery;
- dispute resolution;
- enforcement of contractual obligations.
Information contained in system backups may remain for
a limited period until those backups are overwritten,
rotated or securely deleted according to our normal
backup and retention procedures.
Where information is no longer required for legitimate
business or legal purposes, Windfall will delete,
anonymize or otherwise securely dispose of such information
where reasonably practicable.
Data Deletion and Data Deletion Requests
Users may request deletion of personal information associated
with their GAINS account.

The request should contain sufficient information to help
us identify the relevant account, such as:
- registered email address;
- User ID;
- Company Name;
- other relevant account information necessary to identify the account.
Please do not provide passwords, OTPs or other confidential
authentication credentials when making a deletion request.
Upon receiving a valid request, Windfall may take reasonable
steps to verify the identity and authority of the person
making the request.
Following verification, Windfall will delete or anonymize
applicable personal information within a reasonable period,
subject to information that we are legally or legitimately
required to retain.
Certain information may continue to be retained where
necessary for legal, accounting, taxation, regulatory,
contractual, security, fraud-prevention, backup, audit
or dispute-resolution purposes.
Where a GAINS account has been provided to a User by an
employer, company, distributor, customer or another subscribing
organization, that organization may control the business
and transactional Data associated with the account.
In such cases, Users should also contact their organization's
authorized GAINS administrator regarding deletion of
organization-controlled information.

Windfall discloses Your personal information only
in limited circumstances
Windfall Consultancy Private Limited does not sell Your
personal information.
Windfall may disclose information where disclosure is
reasonably necessary to:
- comply with applicable laws or regulations;
- respond to a valid court order or other lawful request;
- respond to authorized requests from taxation or regulatory authorities;
- protect Windfall's legal rights;
- protect the security and integrity of the GAINS Service;

Windfall does not store Your credit card details
If You make payments for the Service through a payment
gateway, Your complete credit card information is not
stored by the GAINS application.
Payment information may be processed by an authorized
third-party payment gateway provider.
Such payment service providers may collect and process
payment information according to their own terms,
security requirements and privacy policies.
Windfall uses cookies
In providing the Service, Windfall may use cookies and
similar technologies.
Cookies help us provide functionality, maintain sessions,
remember preferences, improve user experience and understand
how our Website and Service are used.
We may use both session cookies, which expire after the
browser session, and persistent cookies, which may remain
on a user's device for a longer period.
Users may configure their browser to restrict or delete
cookies; however, doing so may affect some Website or
Service functionality.
Third-party applications and services
GAINS may allow a Subscriber or authorized User to exchange
or transfer Data with third-party applications or services.
Where a User or Subscriber chooses to transfer information
to an external application or service, the privacy and
security practices of that third party may apply.

privacy practices of independent third-party applications
selected or authorized by Users.

parties before transferring personal or confidential

GAINS is intended for business and organizational use

Windfall does not knowingly solicit personal information
from children for the purpose of providing the GAINS Service.

Users and subscribing organizations are responsible for
ensuring that information entered into GAINS is collected,
used and shared in accordance with applicable laws and
organizational policies.
Users are also responsible for protecting account credentials
and preventing unauthorized access to their GAINS account.

our Service, infrastructure, security practices,
